Terms of Service

These Terms of Service ("Terms") govern your use of the Wippit mobile application and website at getawip.com (collectively, the "Services"), operated by 4vrLive, LLC ("Wippit," "we," "us"). By creating an account or using the Services, you agree to these Terms.
1. What Wippit Is
Wippit is a marketplace that connects three independent parties: customers who want food delivered, restaurants that prepare it, and drivers who deliver it. Wippit is not a restaurant, does not prepare food, and does not employ drivers. Restaurants are independent businesses responsible for their menus, pricing, food safety, and order preparation. Drivers are independent contractors, not Wippit employees — see Section 6.
2. Accounts
You must be at least 18 years old to create a Wippit account. You are responsible for keeping your account credentials secure and for all activity under your account. Restaurant partners and drivers may be subject to additional verification, including identity and background checks for drivers.
3. Ordering, Pricing, and Fees
- Orders have a $12 minimum subtotal, before fees and tax
- Restaurants set their own menu prices
- Delivery is a flat $3.00 fee plus a $1.25 Wippit service fee, shown before checkout
- Wippit does not use surge pricing. Delivery and service fees do not increase for demand, weather, or time of day
- 100% of any tip you leave is paid to your driver
- All fees are disclosed in the app before you confirm your order — there are no hidden charges
4. Refunds and Order Issues
If a restaurant has not yet confirmed your order, you may cancel for a full refund. Once a restaurant confirms, refund eligibility depends on what went wrong:
- Restaurant error (wrong or missing items, order not prepared): eligible for a refund of the affected items
- Driver error (delivered to the wrong address, item damaged in transit): eligible for a refund or credit
- Platform error (app malfunction, duplicate charge): eligible for a full refund of the affected charge

5. Cancellations
You may cancel an order for a full refund at any time before the restaurant confirms it. After confirmation, cancellations are handled case-by-case, since the restaurant may have already begun preparing your food.
6. Drivers Are Independent Contractors
Drivers who deliver through Wippit are independent contractors, not employees, agents, or representatives of Wippit or 4vrLive, LLC. Drivers set their own schedule, choose which delivery offers to accept, and are responsible for their own vehicle, insurance, and tax obligations. Wippit does not direct or control the manner in which a driver performs a delivery beyond the information necessary to complete it.
7. Restaurant Partners
Restaurants that list on Wippit are independent businesses responsible for the accuracy of their menus, the quality and safety of the food they prepare, and compliance with applicable food service laws. Wippit facilitates the connection between restaurants, drivers, and customers and processes payment, but does not prepare or handle food.
8. Prohibited Conduct
You agree not to misuse the Services, including by providing false information, attempting to defraud restaurants or drivers, interfering with the platform's operation, or using the Services for any unlawful purpose.
9. Disclaimers
The Services are provided "as is." Wippit does not guarantee uninterrupted or error-free service, or the quality, safety, or timeliness of any order. To the fullest extent permitted by law, Wippit disclaims all warranties, express or implied.
10. Limitation of Liability
To the fullest extent permitted by law, 4vrLive, LLC's total liability arising from your use of the Services will not exceed the amount you paid to Wippit in the 3 months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes through the app or by email. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Services will be resolved in the state or federal courts located in Kansas.
